Building a Federal Framework for Direct Contracting

The Association for Direct Care supports policies that remove barriers to direct contracting, strengthen employer flexibility and create a clearer federal framework for employers and providers to work together directly.

Create an ERISA Framework for Direct Contracting

Establish a federal framework for employer-provider partnerships that gives employers and providers greater certainty when entering direct arrangements.

Enable Joint Purchasing

Allow employers to aggregate demand and purchase health care through a single contract, giving employers of all sizes greater ability to participate in direct contracting.

Remove Anticompetitive Contract Barriers

Prohibit anti-steering, anti-tiering and all-or-nothing contract provisions that restrict employers’ ability to direct patients toward higher-value care.

Guarantee Access to Health Care Data

Ensure plan fiduciaries have complete access to claims, pricing and audit data needed to manage health benefits and evaluate direct contracting arrangements.

Protect Multistate Arrangements

Clarify federal preemption for multistate direct contracting arrangements and reduce uncertainty created by differing state requirements.

Support Implementation

Provide grants and Department of Labor technical assistance to help smaller providers and administrators build the infrastructure needed to participate in direct contracting.
